Back Injuries Claim Compensation

£2,350 to £154,090*

Awards take account of the meduical findings as to the duration and severity of symptoms 'Pain and suffering ' and the disabling effect on the claimant 'Loss of amenity.'

  • 3 months to 1 year: £2,350 to £4,200.
  • 1 to 2 years £4,200 - £7,500.
  • 2 to 5 years: £7,500 to £11,950.
  • Soft tissue injury resulting in the disturbance of ligaments and muscles leaving the injured person with backache or injuries resulting in exacerbation of pre-existing back problems or surgery to remove prolapsed discs or resulting in repeated relapses. Depending upon the severity of the original injury and whether long term disability results or where an underlying condition has been accelerated by over five years: £11,950 to £24,000.
  • Marked impairment of function with moderately severe constant pain and discomfort with impairment of sexual function caused by crush fractures or displacement of the vertebrae with a probable requirement for spinal fusion, substantial risk of osteoarthritis or by a prolapsed intervertebral disc with substantial acceleration of back degeneration : £24,000 to £36,850.
  • Cases of disc lesions or fractures of discs or of vertebral bodies or soft tissue injuries leading to chronic conditions where, despite treatment (usually involving surgery), there remain disabilities such as continuing severe pain and discomfort, impaired agility, impaired sexual function, depression, personality change, alcoholism, unemployability, and the risk of arthritis. £36,850 to £66,750.
  • Severe back injuries which have special features taking them outside any lower bracket applicable to orthopaedic injury to the back. Such features include nerve root damage with associated loss of sensation, impaired mobility, impaired bladder and bowel function, sexual difficulties, and unsightly scarring £71,000 to £84,750.
  • Cases of the most severe injury involving damage to the spinal cord and nerve roots, leading to a combination of very serious consequences not normally found in cases of back injury. There will be severe pain and disability with a combination of incomplete paralysis and significantly impaired bladder, bowel, and sexual function £87,250 - £154,250. (*See separate section for complete paralysis).
