Back Injuries - £1,750 to £135,000

Back strains/back sprains, disc prolapses and other soft tissue back injuries from which a full recovery has been made ranges from £1,750 to £135,000.

Soft tissue injury resulting in the disturbance of ligaments and muscles leaving the injured person with backache or injuries resulting in exacerbation of pre-existing back problems or surgery to remove prolapsed discs or resulting in repeated relapses. Depending upon the severity of the original injury and whether long term disability results - £9,100 to £20,350.

Moderately severe constant pain and discomfort with impairment of sexual funtion caused by crush fractures or displacement of the vertaebrae with a probable requirement for spinal fusion, substantial risk of osteoarthritis or by a prolapsed intervertebral disc with substantial acceleration of back degeneration - £20,350 to £28,350.

Severe constant pain continuing despite undergoing treatment for disc lesions, or fractures of discs or vertibrae with impaired agility, impaired sexual function, psychiatric problems unemployability and the risk of arthritis - £28,350 to £50,900.

Severe back injuries resulting in incontinence, severely impaired sexual function, unsightly scarring and the possibiliy of future surgery - £59,400 approximately.

Back injury of the greatest severity, short of paralysis, but where there may be very serious consequences not normaly found in orthopaedic back injury cases such as impotence or double incontinence - £73,700 to £126,500.

Examples of Back Injury Compensation calculations.

1. A 22 year old team leader at a logistics company slipped on a spillage and sustained a severe back strain and acceleration of a previously asymptomatic degenerative back condition by a period of five years.

He was unable to work for one month and required some care and assistance at home from his wife.

The claim settled before Court proceedings are commenced.

Damages are calculated as follows:-

£10,000 for the injury, £1,250 for loss of earnings and £250 for non-commercial care. Total damages £11,500.

The client’s contribution to the legal costs is £1,600 (£1,920 including VAT).

The client also has to pay an After the Event Insurance premium of £389.15.  Total deductions from damages: £2,309.15.

Net award to client £9,190.85.

2. A 40 year old production manager sustained a compression fracture of the lumbar vertebra following the collapse of a gantry upon which he was working. The claim settles after Court proceedings have been commenced but before trial. Medical prognosis is for the Claimant to continue to suffer moderate pain indefinitely.

The damages are assessed on the following basis:-

£30,750 for the injury, loss of earnings £7,500 and £1,500 for care by the Claimant’s partner prior to his return to work.  Total damages: £39,750.

In this example the Claimant’s contribution to the costs of the case are £4,200 plus VAT (£5,040 including VAT). The Claimant also has to pay from his damages for an After the Event Legal Expenses Insurance policy premium of £1,861.50.  Total deductions £6,901.50.

The Client receives a net award of £32,848.50.*

*This example assumes that the Claimant's future employment is not affected and that he does not have any continuing disadvantage on the open labour market or future losses.
