Agricultural Accident Claims

Although only 1.5% of the working population is employed in agricultural lines of work, accidents in agriculture account for between 15% and 20% of all work place fatalities. According to HSE, agriculture has one of the worst fatal accident and occupational ill-health records of all major employment sectors in the UK. In the ten year period between 1999 and 2009 a total of 436 people were killed as a result of agricultural work activities – an average of 43 people per year. The HSE has blamed this record on “a deep rooted culture of resourcefulness which at times borders on unwise risk taking”.

If you have suffered an injury whilst working on a farm, involving agricultural machinery or manual handling, or an accident involving other employees or live stock, you may be entitled to claim for your injuries. Carrs Solicitors specialise in work accident claims and our experience and expertise can help you get the compensation you deserve. Common causes of accidents on farms include;

  • Injuries from heavy farm machinery
  • Falling from a height
  • Accidents caused by working with animals
  • Accidents which were a result of a lack of training
  • Accidents involving vehicles, 4x4s, tractors, quad bikes etc.
  • moving or falling objects
  • Asphyxiation or drowning
  • Being trapped under collapsing materials.

What next?

It is important to note any actions, people or practices you think may have contributed to the accident, as well as to take details of any witnesses. Where possible photographs should be taken.

Employers, or the Responsible Person, should report any serious incidents, diseases or dangerous occurrences and any accident that keeps you off work for more than three days. If unsafe working practices or unsafe equipment or facilities result in injury or illness to the worker - the employer is responsible.

One of the problems associated with injuries and losses arising from farming accidents or illnesses is that the injured farm worker is often self-employed or dependent upon their employer for accommodation. Often accidents occur in situations which are unlikely to recur and the root cause is often closer related to the employers approach to risk assessment and training.  At Carrs Solicitors we appreciate the sensitivity of these claims and the importance of maintaining good relations and seeking a constructive resolution of the injured farm workers claim.

We also provide home visits with free initial advice to enable you to make an informed decision ensuring your rights are protected from the outset. Carrs Solicitors have experience of successfully litigating agricultural injury claims gained over the years to include a recent out of court settlement for over £600,000.
